El caso de una menor sin posibilidades de expresar opiniones propias plantea varias cuestiones relacionadas con el tratamiento de personas incapaces. Algunas de ellas son legales, pues se trata de una situación contemplada por la ley; otras son de naturaleza propiamente ética, y han sido objeto de amplio debate. Por este motivo, antes de entrar en las consideraciones éticas, veremos brevemente algunas consideraciones legales pertinentes.
